Privacy policy

Information you give us

• Contact details: your email address and, if you choose, your phone number.
• Your story: the answers you write about the person the song is for, such as their name, your relationship, the occasion, memories, small details and what you want to say, plus any music preferences.
• Gift page content: a photo and personal note you add to the gift page.
• Reaction videos: videos you choose to upload. These are kept private for our review and are never published without your separate permission.
• Revision notes, feedback and messages you send us, including emails to support.

Your story is about another person. Please share only what you are comfortable sharing, and leave out sensitive details such as ID numbers, health information, financial details or a child’s full date of birth.

Payments

Payments are processed by Stripe. We never see or store your full card number. Stripe shares the payment status, amount and your email address with us so we can unlock your song and send your receipt.

Information collected automatically

• Site analytics: we use anonymous browser and visit IDs to count public page visits, form progress and purchases, and to understand which campaign links bring visitors. We also measure time spent on customer pages and form steps, including active, idle and hidden-tab time. We store these records in our own database. Timing records use general page names and step numbers, not your answers, names, payment details or private song links.
• Microsoft Clarity: we use cookies and similar technology to share visits, clicks and scrolling on our homepage and Your Song page with Microsoft for heatmaps and session replays that help us improve the site; sensitive content is masked, and private song, gift, story form, checkout and account pages are excluded. See the Microsoft Privacy Statement.
• Advertising pixels: our homepage and Your Song page use the Meta Pixel and the OpenAI ads measurement pixel. For visitors identified as being in the United States, those public pages also use the Google tag unless you opt out or send a browser privacy signal. Google measurement stays off outside the US or when location is unknown. These tools use cookies to measure whether ads lead to visits and purchases.
• Ad click details: if you arrive from an ad, the relevant pixel can save a reference to that click in a cookie, so a later purchase can be credited to the right ad. Google click references are saved only while Google measurement is on.
• Device details: when you start a song, we record your IP address and browser type. We use a scrambled form of your IP address to prevent abuse, and we delete the original after we report a purchase, or within 8 days if there is no purchase.

We do not load advertising pixels on your private song, gift, story form or account pages.

How we use your information

• To write and produce your song, including the versions and revisions you request.
• To run your private song page and gift page, and to process payments.
• To send service emails, such as your receipt, song updates and access links.
• To contact you by phone or email about your request. If you choose email updates, we may also send song reminders and occasional emails about our gifts and offers. You can unsubscribe at any time.
• To answer your questions, fix problems and prevent abuse of the service.
• To measure how well our ads work.

We will not use your story, song, photos or videos in our marketing without your separate permission.

Who we share it with

We share information only with the companies that help us run the service, and only what each one needs:

• AI music and text services receive your story answers and music preferences so they can compose your song and turn your optional music preferences into musical direction.
• Supabase stores our database and your files. Vercel hosts the website.
• Stripe processes payments. Resend delivers our emails. Google Workspace hosts our support inbox.
• Meta and OpenAI receive ad measurement information: their cookie and click references, your IP address and browser type, a scrambled (hashed) form of your email address, and the fact that you started a song or made a purchase. They never receive your story, song, photos or the recipient’s details.
• Google: we use the Google tag to measure public-page visits and ad clicks for eligible US visitors who have not opted out. For eligible US visitors who have not opted out, we also send Google the fact that a song was started or a paid purchase was made, its time and transaction reference, the ad click reference, a scrambled (hashed) form of the customer’s email address, and the amount and currency of a paid purchase. Google uses this information to match conversions to ads and improve measurement. Ad personalization is off. Your story, song, photos and recipient details are excluded. See Google’s Privacy Policy.

We do not sell your personal information for money. Some state privacy laws treat sharing data with ad platforms to measure or target ads as “selling” or “sharing.” You can opt out at any time as described below.

We may also disclose information if required by law or to protect our rights, our customers or the public.

Private links

Your song page and gift page are reached through private links. Anyone who has a link can open that page, so share them only with people you trust. If a link was shared by mistake, contact us and we will help.

How long we keep it

We keep your story, songs and uploads so your links keep working, until you ask us to delete them. We keep a record of unsubscribed email addresses so we can keep honoring that choice. Payment records are kept as long as tax and accounting rules require.

Your choices

• Emails: use the unsubscribe link in any follow-up email. Service emails about a song you bought will still be sent.
• Google ad choices: use Google ad choices at the bottom of the homepage or Your Song page to turn Google ad measurement, including song-start and purchase reporting, off or back on. We remember your choice in this browser for up to 90 days. Saved refusals keep it off, and we honor Global Privacy Control and Do Not Track signals for Google measurement. Turning it off clears Google ad-click cookies on this site, reloads the page to remove the Google tag, and asks our server to stop pending Google reports. If that request is not yet confirmed, the choice panel tells you and retries. Reports already sent cannot be recalled by this control. This choice applies to Google; the other services described here have separate controls.
• Ad cookies: block or clear cookies in your browser settings, and adjust your ad preferences in your Meta, ChatGPT and Google account settings.
• Opt out of ad sharing: email us and we will stop sending your information to ad platforms.
• Access, correction and deletion: email us to get a copy of your information, correct it or delete it. We respond within 30 days.

Email support@yourgiftsmith.com from the address you used with us, so we can confirm the request is yours.

Children

Our service is for adults. You must be 18 or older to make or buy a song. We do not knowingly collect information from children under 13. Songs may be about children, which is why we ask you to leave out sensitive details.

Security

We use encrypted connections, private file storage and private links that are hard to guess. No system is perfectly secure, so we cannot guarantee absolute security.

Changes to this policy

If we change this policy, we will post the new version on this page and update the date at the top.
